These Terms and Conditions govern your use of the Dealership website and services, which let people buy and sell cars directly with each other, including cars bought with a loan or with a loan still on them. By creating an account or using the services, you agree to these terms.
1. Who can use Dealership
You must be at least 18 years old and able to enter into a binding contract. You may use the services only for your own personal purchases and sales, not as a business that resells cars.
2. Your account
You are responsible for the information in your account and for keeping your login details safe. Tell us right away if you think someone else has access to your account.
We may suspend or close an account that breaks these terms or that we believe is used for fraud.
3. Listing a car
When you list a car, you confirm that you own it or have the right to sell it, and that the details, photos and answers about its condition are accurate and complete.
Listings go live without a prior review. We may remove a listing that is misleading, unsafe or against these terms.
4. Offers and sales
Buyers send offers through the platform; sellers accept, decline or answer with their own price. An accepted offer takes the car off the marketplace while the sale is completed.
Each sale is completed through a licensed partner dealer, who handles the title, the documents and, when a loan is involved, the lender. The purchase agreement is signed electronically.
5. Fees and payments
Listing a car is free. The buyer pays a platform fee for each purchase and, when the car is bought with a loan, a fee for the GPS tracker. Optional products such as a warranty or delivery are priced separately and shown before you sign.
Payments go through the platform, never directly between buyer and seller. The sale price appears on the seller's balance when the sale is complete and can be withdrawn after the holding period shown in the account.
6. Cancellations and refunds
Before the purchase agreement is signed, either side can cancel without a fee. After signing, the cancellation fee stated in the agreement applies.
Amounts the buyer has paid are refunded as described in the agreement, to the original payment method.
7. Loans
Loan offers are made by partner banks, not by Dealership. A pre-approval is not a final approval, and the bank's decision is final. Checking your offers does not affect your credit score; a final application may.
8. Inspections
A mechanic at one of our locations can inspect a listed car. An inspection describes the car's condition on that day and is not a warranty.
9. What you may not do
You may not post false or misleading information, try to complete a sale outside the platform, use the services for fraud or money laundering, or interfere with how the website works.
10. Disclaimers and limits of liability
The services are provided as they are. To the extent the law allows, Dealership is not liable for indirect or consequential losses, and our total liability is limited to the fees you paid us in the twelve months before the claim.
11. Disputes
If something goes wrong, contact us first: most problems can be solved quickly. Any remaining dispute is resolved under the laws of the State of Texas, unless the law where you live requires otherwise.
12. Changes to these terms
We may update these terms. If the changes are significant, we will tell you by email or in your account before they take effect.
